By accessing and using StemSplitter ("the Service") at stemsplitter.xyz, you accept and agree to be bound by the terms and provision of this agreement.

If you do not agree to abide by the above, please do not use this service.

Permission is granted to temporarily use StemSplitter for personal, non-commercial use. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the Service
• Use the Service for any commercial purpose without explicit permission
• Attempt to reverse engineer or extract the source code
• Remove any copyright or proprietary notations
• Transfer the Service to another person

StemSplitter is an AI-powered web application that separates audio files into individual instrument tracks (stems). The Service:

• Processes audio files uploaded by users
• Separates audio into 6 stems: vocals, drums, bass, guitar, piano, and others
• Provides separated stems for download
• Is provided "as is" without warranties

StemSplitter offers free access with the following limits:

• 3 free trials per day - Maximum 3 audio files processed per 24-hour period
• 50MB maximum - Each audio file must be 50MB or less
• 50MB file size limit - Maximum file size per upload

These limits may change at any time. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

You are responsible for:

• Copyright Compliance: Ensuring you have the legal right to use and process the audio files you upload
• Content: Not uploading illegal, harmful, or offensive content
• Usage: Using the Service in accordance with all applicable laws and regulations
• Account Security: Maintaining the security of any account credentials (if accounts are introduced in the future)

You agree not to use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload malicious software or viruses
• Attempt to overload or disrupt the Service
• Use automated systems to bypass usage limits

Your Content

You retain ownership of any audio files you upload. By uploading files, you grant us a limited license to:

• Process the files to provide the separation service
• Store files temporarily (up to 24 hours)
• Delete files after processing is complete

Our Content

All content, features, and functionality of StemSplitter, including but not limited to text, graphics, logos, and software, are the property of StemSplitter and are protected by copyright, trademark, and other intellectual property laws.

Separated Stems

You own the separated stems generated from your uploaded files. However, you are responsible for ensuring you have the legal right to use the original audio file and the separated stems.

StemSplitter respects intellectual property rights. If you believe that any content on our Service infringes your copyright, please contact us at motionjoy93@gmail.com with:

• A description of the copyrighted work
• Identification of the infringing material
• Your contact information
• A statement of good faith belief that the use is not authorized

We will respond to valid DMCA takedown notices in accordance with applicable law.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of results

We do not guarantee that:

• The Service will be uninterrupted or error-free
• Results will meet your expectations
• Any defects will be corrected

To the fullest extent permitted by law, StemSplitter shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any errors or omissions in the Service
• Any loss or damage of any kind incurred as a result of your use of the Service

You agree to indemnify and hold harmless StemSplitter, its operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice, for any reason, including but not limited to:

• Violation of these Terms of Service
• Abuse of the Service or usage limits
• Illegal or harmful activity
• At our sole discretion

Upon termination, your right to use the Service will cease immediately.
